The short version

Observe is a performance-improvement service. We collect the information needed to run accounts, store your private performance history, analyse submitted content, generate Observations, process purchases and keep the service secure.

Individual Observe accounts are for people aged 15 and over at launch. Users aged 15–17 receive additional youth privacy and safety protections. A person under 15 may not create or independently operate an individual Observe account. An eligible adult account holder may submit a performance involving a younger person where they have the legal right and any permission or authority required.

Performance videos remain private in the account until the account holder deletes them or the account is deleted, subject to limited legal and backup retention.

This policy is a separate document from our Terms of Use, published at https://observe-me.com/terms, which sets out the rules for using Observe.

Part A — Scope and what we collect

1. Scope and who we are

This Privacy Policy applies to the Observe progressive web app (PWA), the Observe website and related services operated by Edduus Pty Ltd trading as Observe (Observe, we, us or our). It explains how we handle personal information under applicable privacy law, including the Australian Privacy Principles where they apply and applicable United States state privacy laws where Observe is subject to them.

2. Age and age-band information

At launch, individual account applicants select an age band: Under 15, 15–17, or 18+. We use this age-band information to determine account eligibility and apply appropriate youth privacy and safety settings. We do not ordinarily need your exact date of birth for account creation, but we may use reasonable and proportionate age-assurance measures where required or appropriate.

A person under 15 may not create or independently operate an individual Observe account at launch. If we reasonably believe an individual account holder is under 15, we may restrict or close the account while we review the issue. People under 13 remain ineligible to create or independently operate an account. The full eligibility rules are set out in our Terms of Use.

3. Personal information we collect

Depending on how you use Observe, we may collect:

  • Account information, such as your name, email address, account identifier, login details and selected age band.
  • Performance content, including videos, images, audio, text and other material you record, upload or submit for analysis.
  • Observation data and outputs, including detected or inferred skills and capabilities, capability indicators, measurements, scores, comparisons, detected movements, objects or features, AI-generated analysis, feedback, reports, questions and answers about an Observation, and links between an original Observation and any Re-Observation used to measure change over time.
  • Report and export information, such as when you choose to download or share an Observation report or AI-generated output outside Observe.

Generated improvement media, such as personalised “Show Me Better”, Reimagine, “See the Fix” or similar visual or video outputs created from or by reference to submitted performance content.

Referral and affiliate information, where those features are offered, such as referral codes or links, attribution records, qualifying purchases, discounts and commission-related transaction records.

  • Payment and transaction information, such as purchase history, credits and transaction status. Card details may be handled by our payment provider rather than stored by Observe.
  • Device, browser and PWA information, such as IP address, browser type, device type, operating system, app version, identifiers, diagnostic logs, security events and usage information.
  • Permission information, such as whether you allow camera, microphone, photo-library or notification access. You can manage these permissions through your browser or device settings.
  • Support and communications, including messages, feedback, complaints and content you send to our support team.

Uploaded video or audio may incidentally reveal information that is more sensitive, such as health, disability, racial or ethnic information. We do not ask you to provide sensitive information unless a feature clearly requires it and we have an appropriate legal basis or consent to handle it.

4. How we collect information

We collect information directly from you when you create an account, record or upload content, make a purchase, export or share a generated report, contact us or change a setting.

Where an eligible adult account holder submits a performance involving another person, we receive that performance content from the adult account holder. Where a school, sporting organisation or other approved institution uses Observe, we may receive performance content and related information from its authorised adult users. We do not ordinarily need to collect the underlying parent, school or club permission records unless needed to verify authority, resolve a complaint or comply with law.

We also collect some information automatically when you use the PWA, and may receive transaction, security or technical information from service providers that help us operate Observe.

Part B — How we use and share information

5. Why we use personal information

We use personal information to:

  • create and manage your Observe account;
  • receive, process and analyse the content you submit;
  • generate Observations, guidance, reports, answers to questions, personalised improvement media and related features;

compare a Re-Observation with an earlier Observation, measure changes in the same skills, capabilities or indicators, identify remaining performance gaps, and maintain a performance history over time;

  • let you download or share generated Observation reports and AI outputs when you choose to do so;
  • process purchases and manage credits;
  • provide customer support and respond to complaints;
  • secure the service, prevent abuse, investigate suspected misuse and enforce our Terms of Use;
  • maintain, troubleshoot and improve the reliability and usability of Observe;
  • send service messages and, where permitted, marketing communications;
  • comply with legal obligations and protect the rights, safety and security of users, Observe and others.

6. AI and automated analysis

Observe uses artificial intelligence, computer vision and other automated technologies to analyse content and generate performance guidance. Depending on the feature, this may involve detecting or estimating movements, positions, objects, sequences, skills, capabilities, indicators or other features relevant to the Observation requested. Observe may also compare a later Re-Observation with an earlier Observation to describe changes and remaining performance gaps.

Observe may analyse visual features needed to assess performance, but the service is not designed to identify who a person is using facial recognition. AI-generated outputs can be wrong or incomplete and should be treated as guidance, not as a guaranteed fact or professional certification.

Some features may use information from an Observation together with general domain information to answer a user’s questions or generate personalised improvement media. A generated illustration, image or video showing what to aim for is guidance or visualisation; it is not evidence of what the person actually did. New claims about a person’s performance require new submitted evidence, such as a Re-Observation.

We may use specialist service providers, including AI, computer-vision, media-generation and cloud providers, to process information on our behalf where needed to provide a requested feature. Different providers may perform different parts of the service. We do not state or imply that a single AI provider processes every Observe feature. Their handling of information is governed by our arrangements with them and applicable law.

7. Content that includes other people

You must have the right to record, upload and use content that includes another identifiable person. If the performance involves a child or another person who is not the account holder, the adult account holder must have any permission, authority or lawful basis required to record and submit that performance for analysis. This may include a parent or guardian using their own account, or an authorised adult acting for a school, sporting organisation or another organisation.

A younger person does not become an Observe user merely because they appear in a performance submitted by an eligible adult. Performance videos are private and are not published or made discoverable to other Observe users through Observe at launch.

8. Institutional and authorised adult use

Schools, training providers, sporting clubs, associations and other organisations may use Observe through eligible individual accounts or organisation-authorised accounts. Where an organisation uses an adult-operated account to submit another person’s performance, the organisation is responsible for the notices, permissions, safeguarding approvals and authority required of it for the recording and approved use. Observe remains responsible for the privacy, security and other legal obligations that apply to Observe as the provider of the service.

A student, learner, junior athlete or other person does not become an Observe account holder merely because an authorised account holder submits their performance through an organisation-approved account. Separately, a person aged 15–17 may hold their own eligible individual account under the youth settings that apply to that account. We may require reasonable evidence of organisational authority where an account is being used on an organisation’s behalf.

Additional school, student-record, youth-sport or child-privacy rules may apply depending on the jurisdiction and deployment. Those requirements may be addressed in a separate school, club or data-processing agreement where appropriate.

Australian privacy requirements for children are also evolving. The Children’s Online Privacy Code is due to be finalised by 10 December 2026 and may apply to online services likely to be accessed by people under 18. Observe will review the final Code and update its youth privacy settings, notices and this policy where required before applicable obligations take effect.

For US use, children under 13 remain subject to additional child-privacy requirements, including COPPA where it applies. Observe does not permit under-13s to create or independently operate accounts. Adult-submitted content about a child and direct online collection from a child can raise different legal issues; Observe will apply the requirements that actually apply to the relevant deployment and feature rather than relying on account status alone.

9. When we disclose information

We may disclose personal information:

  • to technology and service providers that help us host, secure, analyse, support or operate Observe;
  • to payment providers and financial service providers to process transactions;
  • to professional advisers, insurers or auditors where reasonably necessary;
  • to law enforcement, regulators, courts or other parties where required or authorised by law;
  • in connection with a genuine business reorganisation, financing, acquisition or sale, subject to appropriate confidentiality and legal safeguards;
  • to a recipient or third-party app when you deliberately export or share a generated report or AI output using your device or browser sharing tools.

We do not sell personal information for money.

10. Overseas processing and disclosure

Some service providers may process or store personal information outside Australia. Where required, we take reasonable steps to protect personal information handled by overseas recipients.

Likely countries in which overseas recipients may be located: United States and other countries in which our contracted cloud, AI or technology service providers process data, as identified and updated through our provider review process.

11. Cookies, local storage and PWA technologies

Observe may use cookies, browser local storage, service workers and similar web technologies for login, security, preferences, caching and PWA functionality. We may also use analytics technologies to understand how the service is used and to improve reliability. Where law requires a choice or consent for optional technologies, we will provide it.

12. Marketing communications

We may send service messages that are necessary to operate your account. We will only send marketing communications where permitted by law. You can unsubscribe from marketing at any time using the method provided in the message or your account settings. Unsubscribing from marketing does not stop essential service or security messages.

Part C — Retention, security and deletion

13. Retention and deletion

Performance videos and related performance media are intentionally stored privately as part of the account holder’s performance history so the account holder can review earlier performances, use Re-Observe and compare progress over time. Stored performance media remains in the account until the account holder deletes the relevant media or Observation, or the account is deleted, subject to any shorter period required by law or an institutional agreement. Observe does not publish stored performance media or make it discoverable to other Observe users at launch.

Within the product, the account holder controls deletion of stored performance videos and Observations. Observe may also remove information where required by law, necessary to enforce our Terms of Use, or in response to a valid privacy, safety or legal request. When an account is deleted, we begin deletion or de-identification of the account’s stored performance media and Observation history, subject to limited legal, financial, security and backup retention.

Retention schedule

  • Performance videos and associated performance media: retained in the active account until the account holder deletes the relevant video or Observation or deletes the account, unless a shorter period is required by law or contract.
  • Observation reports, scores, analysis and performance history: retained while the account holder chooses to keep them in the active account, and deleted or de-identified when the relevant Observation or account is deleted unless a lawful retention exception applies.
  • Account/profile information: retained while the account is active. After an account-deletion request, deletion from active systems will be completed within 30 days.
  • Deleted performance media: removed from user-facing access when the delete action completes and permanently removed from active storage within 30 days.
  • Backups and disaster-recovery copies: deleted content may remain in secure backups for up to 90 days before those backups expire or are overwritten. Backup-only copies are not used for ordinary product purposes.
  • Transaction, tax, fraud-prevention, security and legal records: retained only for the period required by applicable law or reasonably necessary for the specific accounting, security, dispute or legal purpose.
  • Support and complaint records: retained for 3 years after the matter is closed unless a longer period is required for an unresolved dispute, safety issue or legal obligation.

We periodically review retention settings and will update this policy if the product or applicable law requires materially different retention periods.

14. Security and data breaches

We use technical and organisational safeguards designed to protect personal information against loss, misuse, interference and unauthorised access, modification or disclosure. No online service can guarantee absolute security. If a data breach occurs, we will investigate it and make notifications required by applicable law.

15. Closing your account

You may close your account through Settings > Account > Delete Account or by following the process at https://observe-me.com/account/delete. If you cannot access your account, contact privacy@observe-me.com.

Before deleting your account, review any unused paid credits or active paid service, as explained in our Terms of Use.

16. What account deletion does

When you request account deletion, we begin closing your Observe account and deleting or de-identifying personal information associated with it. This generally includes stored performance videos and other private performance media, profile information, Observation reports, scores and performance history, subject to the limited exceptions below.

17. Information we may retain

We may retain limited information where required or permitted by law or reasonably necessary for purposes such as financial records, fraud prevention, security, dispute resolution, enforcing our Terms of Use or documenting a legal or safety report. Where possible, we limit retained information to what is necessary for that purpose.

18. Backups and technical records

Deleted information may remain temporarily in secure backups, logs or disaster-recovery systems for up to 90 days until those records expire or are overwritten. Information retained only in backup systems is not used for ordinary product purposes. Deletion from active systems will be completed within 30 days unless a lawful exception applies.

19. Reports or outputs you exported or shared

Deleting your account removes or de-identifies information within our control in accordance with this policy. If you exported or shared an Observation report or AI-generated output and another person saved or copied it outside Observe, deleting your account cannot delete copies that are no longer under our control.

20. What deletion does not do

  • It does not erase information that another person lawfully holds outside Observe.
  • It does not necessarily reverse a completed payment transaction.
  • It does not remove records we are legally required or permitted to retain.
  • It does not prevent us from retaining minimal information needed to stop a banned user immediately recreating an abusive account where that retention is lawful and proportionate.

Part D — Your privacy rights

21. Access and correction

You may request access to personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We may need to verify your identity before completing a request. Some exceptions may apply under law.

If you want a copy of your personal information or need information corrected rather than deleted, contact privacy@observe-me.com.

22. Performance content about you submitted by another account holder

If another account holder submitted performance content that identifies you and you believe it should be removed, contact privacy@observe-me.com with enough information for us to locate the relevant Observation. We may need to verify your identity and consider the account holder’s authority, consent, safety issues and applicable law.

23. Requests involving a person under 18

If content shows a person under 18 and you are their parent or legal guardian, you may contact privacy@observe-me.com to request review or removal. A user aged 15–17 may also use the privacy request channels available to account holders. We may ask for information reasonably necessary to confirm identity or authority and identify the relevant content.

24. Requests involving school or student information

If content or personal information was submitted through a school-approved account, a parent, guardian, eligible student or the school may contact privacy@observe-me.com about access, correction, review or deletion. We may coordinate with the school to verify the request, determine who is entitled to act, preserve records the school is legally required to retain, and comply with applicable privacy or student-record laws and the school’s agreement with Observe.

25. Requests involving sporting-organisation or junior-athlete information

If content or personal information was submitted through a sporting-organisation-approved account, a parent or legal guardian, the athlete where appropriate, or the organisation may contact privacy@observe-me.com about access, correction, review or deletion. We may coordinate with the organisation to verify the request, confirm authority and permission status, preserve records that must lawfully be retained, and comply with applicable privacy, safeguarding or child-protection requirements and the organisation’s agreement with Observe.

26. United States privacy rights

If you live in the United States, privacy laws in your state may give you additional rights concerning personal information. Depending on the law that applies to Observe and to you, those rights may include access, correction, deletion, portability, and rights relating to the sale, sharing, targeted advertising or certain profiling uses of personal information.

Observe makes its access, correction and deletion request channels available to all users even where a particular US state privacy statute does not apply. We do not sell personal information for money. If a law that applies to Observe treats any analytics, advertising or other disclosure as a sale, sharing or targeted-advertising activity, we will provide the notices and choices required by that law.

To exercise an applicable US privacy right, contact privacy@observe-me.com or use https://observe-me.com/privacy-request. We may need to verify your identity and may deny or limit a request where an applicable legal exception permits. You may also have a right to appeal certain decisions about a privacy request where required by state law.

27. Complaints

If you believe we have mishandled your personal information, contact us at privacy@observe-me.com. We will review the issue and respond within a reasonable period. If you are not satisfied, you may have the right to complain to the Office of the Australian Information Commissioner or another relevant privacy regulator.

28. Changes to this policy

We may update this policy as Observe changes. We will publish the updated version with a new effective date and give additional notice where a change materially affects how we handle personal information.
