How the Observe Affiliate Program works: eligibility, the 5% customer discount, 10% continuing commissions, PayPal payments, the AUD $25 minimum payout and Passive Affiliate status.
The Observe Affiliate Program rewards eligible individuals and registered organisations for referring customers to Observe ("we", "us" or "our").
By registering for the Affiliate Program, an Affiliate agrees to these Terms and Conditions.
The program operates on a continuing commission model: Affiliates earn commissions on qualifying purchases from customers they introduce, without a fixed expiry period.
Individual Affiliates must be at least 18 years old, have the legal capacity to enter into an agreement and maintain an eligible PayPal account. Individuals under 18 are not permitted to register as Affiliates.
Legally recognised registered organisations may participate, including companies, incorporated sporting clubs, registered associations, charities and other eligible entities. Organisations must register through an authorised representative aged at least 18. The representative must have authority to accept these Terms on behalf of the organisation. Observe may request reasonable evidence of identity, age, registration or authority.
Approved Affiliates receive a unique referral code, link or identifier. When an eligible customer purchases through a valid referral:
The customer receives a 5% discount on qualifying purchases.
The customer is attributed to the Affiliate.
The Affiliate earns 10% commission on the Net Purchase Value.
Subsequent qualifying purchases by that customer continue generating commissions.
Each customer account may ordinarily be attributed to one Affiliate. Existing attribution is not automatically replaced by a subsequent referral code.
The Affiliate earns 10% of the Net Purchase Value of each qualifying purchase. Net Purchase Value means the purchase amount actually received by Observe after customer discounts, excluding GST or other sales taxes, refunds, chargebacks and reversed payments.
Once a customer is validly attributed to an Affiliate, the Affiliate remains entitled to commissions on that customer’s future qualifying purchases for as long as those purchases continue. There is no fixed time limit on an established referral relationship. Customer inactivity does not automatically cancel attribution. This entitlement remains subject to the transaction eligibility, fraud and termination provisions of these Terms.
Commissions are not payable on free credits, refunded or cancelled transactions, fraudulent referrals, unauthorised self-referrals, or purchases excluded under a separately agreed enterprise arrangement.
All Affiliate commissions are paid through PayPal. Affiliates must maintain an eligible PayPal account capable of receiving payments. Organisational Affiliates must provide a PayPal account legitimately operated by or on behalf of their organisation. Affiliates are responsible for maintaining accurate PayPal details and satisfying PayPal’s account requirements.
Observe calculates and processes approved Affiliate commissions monthly. Approved amounts meeting the minimum payment threshold will ordinarily be paid within 30 days following the end of the month in which the commissions become eligible for payment.
The minimum Affiliate payout is AUD $25, or its equivalent in the relevant payment currency. Where an Affiliate’s approved commission balance is below AUD $25, the balance automatically carries forward. The balance continues accumulating until it reaches the minimum payout threshold. No commission is forfeited simply because the threshold has not yet been reached.
Commissions may remain pending for up to 30 days after the customer transaction to allow for refunds, chargebacks, reversals and fraud checks.
Fees charged by PayPal to an Affiliate receiving a payment, including any applicable currency conversion fees, are the responsibility of that Affiliate unless otherwise agreed in writing. Observe is not responsible for delays caused by incorrect payment information or PayPal account restrictions outside Observe’s reasonable control. Legitimately earned commissions remain recorded while valid payment arrangements are being resolved, subject to applicable law.
An Affiliate is not required to remain actively involved in promoting Observe to continue earning commissions from previously referred customers. An Affiliate who stops promoting Observe may retain Passive Affiliate status. Under Passive Affiliate status:
Existing, valid customer attribution remains active.
Qualifying purchases by previously referred customers continue generating commissions.
The standard 10% commission rate remains applicable to those existing referral relationships.
Approved balances continue accumulating.
Monthly payments continue through PayPal once the AUD $25 threshold is met.
No minimum promotional activity, referral quota or customer acquisition target is required.
Passive Affiliates must maintain current payment and contact information and comply with the applicable provisions of these Terms. A Passive Affiliate may resume active participation, subject to any reasonable account verification requirements. Inactivity alone is not grounds for cancelling legitimate ongoing commissions.
Where a qualifying transaction is refunded, reversed or charged back, the corresponding commission may be cancelled or adjusted. If the commission has already been paid, Observe may reasonably offset the affected amount against future commissions after providing an explanation. Observe will not arbitrarily cancel legitimate commission earnings.
Affiliates must promote Observe accurately, honestly and lawfully. Affiliates must disclose their commercial relationship when making recommendations that may earn commissions. Affiliates must comply with applicable consumer protection, advertising, privacy and anti-spam laws. Fraudulent referrals, misleading claims, impersonation, manipulated transactions and unauthorised use of customer information are prohibited. Affiliates cannot enter into contracts or make binding promises on behalf of Observe.
Observe permits Affiliates to use approved promotional materials solely for legitimate Affiliate Program activity. All Observe intellectual property remains owned by Observe or its licensors. Affiliates must not misrepresent themselves as the official Observe business or use Observe branding in misleading ways.
Affiliate information is handled in accordance with the Observe Affiliate Privacy Policy. Observe may share information reasonably necessary to process commissions with PayPal and relevant financial or compliance service providers. Affiliates do not receive access to customers’ private Observe videos, reports, assessments, advice requests, payment credentials or confidential account information.
Affiliates are responsible for their own taxation and reporting obligations. Observe may request ABN, GST or other tax information where required. Affiliate commissions are calculated excluding applicable taxes on customer purchases. GST treatment of commission payments is determined separately according to applicable tax law.
Observe may suspend an Affiliate account on reasonable grounds involving suspected fraud, unlawful activity, serious misconduct or material breach of these Terms. Where lawful and practicable, Observe will notify the Affiliate and provide a reasonable opportunity to respond.
Observe may terminate participation for established fraud, serious misconduct or unresolved material breach. Legitimately earned commissions unrelated to the misconduct remain payable, subject to law. Commissions connected with established fraudulent referrals may be cancelled.
Observe may terminate an Affiliate’s ability to generate new referrals by giving at least 30 days’ written notice. Termination without cause does not automatically extinguish ongoing commission rights associated with existing valid customer referrals.
Affiliates may request account closure. Where an Affiliate wishes to cease promoting Observe while preserving existing earnings, the Affiliate may elect Passive Affiliate status rather than closure. Before voluntary closure is completed, Observe will explain the effect on continuing commissions and outstanding payments. Any remaining legitimate commission entitlement will be handled in accordance with these Terms and applicable law.
Observe may reasonably amend administrative arrangements, payment procedures and program operations. Material changes will ordinarily be communicated at least 30 days before implementation. Changes to commission rates apply to new referral relationships unless an affected Affiliate expressly agrees otherwise. Observe will not retrospectively reduce commission rates or impose a fixed expiry on existing valid referral relationships without the affected Affiliate’s agreement. Changes required by law, payment-provider requirements or significant security risks may take effect sooner where reasonably necessary.
Affiliates participate as independent parties, not employees, agents, partners or franchisees of Observe. Observe does not guarantee a particular income, customer conversion rate, sales volume or level of commission earnings.
Observe will take reasonable steps to administer the Affiliate Program accurately and reliably. Where verified system errors affect attribution or commission calculations, Observe will take reasonable steps to correct them. Neither party excludes or limits rights or liabilities that cannot lawfully be excluded or limited.
Affiliates may submit disputes concerning attribution, commissions, payments or account decisions to Observe Affiliate Support. Observe will review disputes in good faith and endeavour to provide a substantive response within 30 days. The parties agree to attempt reasonable informal resolution before commencing proceedings, except where urgent legal relief is required or applicable law provides otherwise.
These Terms are governed by the laws of Western Australia, Australia, subject to any mandatory rights or protections under applicable law.
